Verve Intimate – Privacy Policy

At Verve Intimate, your privacy, comfort, and trust are at the heart of everything we do. We understand that boudoir photography is a deeply personal and empowering experience, and we are fully committed to keeping your images and personal information safe, confidential, and protected at all times.

In handling your personal information, Verve Intimate is bound by the Privacy Act 1988 (Cth) (Privacy Act) and the Australian Privacy Principles (APPs) contained in that Act. This policy explains what personal information we collect, how we collect, hold, use and disclose it, how you can access or correct it, and how to make a privacy complaint. This policy may be updated from time to time — see Section 14 below.

1. Confidentiality Promise

All sessions, images, and client information are treated with the highest level of confidentiality. Your images will never be shared, published, or displayed without your explicit consent.

  • No images are used for marketing, portfolio, or social media purposes unless you have signed a separate model release.
  • Choosing not to sign a model release has no effect on the quality of your session or the services provided.
  • Only authorised Verve Intimate staff, contractors (e.g. editors) and suppliers (e.g. photo lab) may access your images, and only for essential professional purposes.

2. What Personal Information We Collect

Personal information is information or an opinion about an identified, or reasonably identifiable, individual. In providing our services, Verve Intimate may collect:

  • Contact and identification information, such as your name, address, phone number(s) and email address;
  • Images of you captured during your photography experience;
  • Booking preferences and details about your session, including styling, hobbies or interests, used to personalise your experience;
  • Payment and billing details, for the purpose of processing payment for your session, products or vouchers;
  • Any other information you voluntarily provide to us during your interactions with Verve Intimate.

You are under no obligation to provide your personal information to us. However, without certain information, we may not be able to provide our services to you.

3. How We Collect Your Personal Information

Generally, we collect your personal information directly from you, through:

  • Booking forms completed online or in person, including via our website;
  • Face-to-face meetings, phone calls, emails, or other direct correspondence;
  • Your photography session itself; and
  • Cookies or similar technologies when you use our website, where applicable.

On rare occasions, we may collect personal information about you from a third party (for example, if you are referred to us by a friend or family member) where it is unreasonable or impractical to collect it from you directly.

4. How We Use Your Personal Information

We collect, hold, use and disclose your personal information where reasonably necessary to:

  • Provide your photography session, including bookings, consultations, image delivery, prints, albums and vouchers;
  • Communicate with you about your booking, orders, enquiries or requests;
  • Process payments and carry out accounting, billing and other internal administrative purposes; and
  • Carry out market and product analysis to improve our services.

We will only use your image, quotes or other content in marketing materials, on our website, portfolio or social media where you have given explicit consent (see Section 1). We may also use your personal information for related purposes you would reasonably expect, or where otherwise permitted or required by law.

5. Image Storage and Security

Your images are securely stored in password-protected systems. We take steps reasonable in the circumstances to protect your personal information from misuse, interference, loss, unauthorised access, modification or disclosure, including:

  • Digital files are stored internally on secure servers with limited staff access. Our servers are held offsite in a data centre to help prevent loss through fire or theft;
  • Digital files are also made available to you through a password-protected online gallery;
  • Files transmitted outside of Verve Intimate are only sent through secure, password-protected links or private client galleries; and
  • We do not sell your personal information or images to any third party.

6. Who We Disclose Your Information To (Including Overseas)

We disclose your personal information only for the purposes set out in this policy, or as otherwise required or authorised by law. This may include disclosure to:

  • Authorised Verve Intimate staff, and contractors such as photo editors, engaged to perform services on our behalf;
  • Suppliers involved in the production of your photography products, such as photo labs and print providers;
  • Third-party providers of financial or payment processing services, where needed to process your payment;
  • Our professional advisors, such as accountants or lawyers, where necessary; and
  • People or entities considering acquiring an interest in Verve Intimate’s business or assets, on a confidential basis.

Overseas disclosure: Verve Intimate engages contractors and staff located overseas who may support functions such as photo editing, telephone and customer service support, administration, human resources and finance. Where this occurs, your personal information — which may include your contact details, images, booking information or payment-related records, depending on the function being performed — may be accessed or processed outside Australia.

We take reasonable steps to ensure that any overseas personnel and contractors handle your information securely and in a manner consistent with this policy and the Australian Privacy Principles, including through secure systems, restricted access, and confidentiality obligations in our contractor and employment agreements.

We do not otherwise share or sell your personal information or images to third parties for their own use.

7. Direct Marketing

With your consent, Verve Intimate may use your contact details to send you information about services, products, offers or promotions that may be of interest to you, from Verve Intimate or selected third parties. You can opt out of direct marketing at any time by:
  • Emailing [email protected] or calling 1300 860 831;
  • Clicking the unsubscribe link in any marketing email we send you; or
  • Using any other opt-out mechanism we provide (for example, in an SMS message).

8. Retention and Deletion of Files

  • Images you purchase are securely archived and retained indefinitely.
  • Images you do not purchase are eventually deleted to make space for future sessions. This does not happen immediately, but typically occurs between 6-12 months following your session.
  • Once  non purchased images have been cleared from our systems, they cannot be recovered.
  • You may request early deletion of your purchased images or remaining files at any time by contacting us at [email protected] or 1300 860 831.

9. Privacy During Your Session

  • All our photographers are female and only female staff will be in your shoot experience.
  • You may request a closed studio for additional privacy, where only your photographer is present in the studio room.
  • We ensure a professional, respectful environment where your comfort is our priority.
  • At times, a Verve Intimate content creator may be present in the studio to capture behind-the-scenes highlights — including hair and makeup, your session, and your image reveal. You will always be given the opportunity to opt out of having your experience highlights captured before this takes place.

10. CCTV

CCTV is used in Verve Intimate locations for security and compliance purposes. CCTV cameras are only located in foyer and/or design cinema areas, and are never used in photography studios or change rooms.

11. Call Recording

Inbound and outbound phone calls to and from Verve Intimate may be recorded for quality control, training and coaching purposes.

12. Your Rights – Access, Correction and Deletion

You have control over your personal information and images. At any time, you may request to:
  • Access and review the personal information we hold about you;
  • Correct any personal information that is inaccurate, out of date, incomplete or misleading;
  • Request deletion of your data or images (see Section 8); and
  • Withdraw any prior consent you have given for image use or marketing.
To help us locate your information and protect your privacy, we may ask you to provide proof of identity. In some cases, a reasonable administration fee may apply to cover the cost of an access request, where permitted by law. We will respond to your request promptly and take steps to ensure your information remains accurate, complete and up to date. Requests can be made by email to [email protected] or by phone on 1300 860 831, and will be honoured promptly.

13. Privacy Complaints

If you have a concern or complaint about how we have handled your personal information, please contact Verve Intimate’s Privacy Compliance Officer at [email protected] or 1300 860 831. Your complaint will be:
  • Treated seriously;
  • Dealt with promptly;
  • Handled in a confidential manner; and
  • Will not affect your existing obligations or commercial relationship with Verve Intimate.
If you are not satisfied with the outcome of your complaint, you may refer the matter to the Office of the Australian Information Commissioner (OAIC).

14. Policy Updates

This policy may be updated from time to time to reflect new privacy practices or legal requirements. Any updates will be posted on our website, and you will be notified if a change materially affects your rights.
