1. Acceptance of Terms

1.1 By entering this Promotion, the entrant acknowledges and agrees that they have read, understood, and accepted these Conditions of Entry (including the Schedule).
1.2 Any capitalised terms used in these Conditions of Entry have the meaning given in the Schedule, unless otherwise stated.
1.3 Entry into the Promotion is deemed acceptance of these Conditions of Entry and the Schedule.

2. Eligibility

2.1 Valid and eligible entries will be accepted during the Promotion Period only.
2.2 Entries are deemed received at the time they reach the Promoter, not when sent by the entrant. The Promoter’s records are final and conclusive as to the time of receipt.
2.3 Employees (and their immediate family members) of the Promoter, its distributors, suppliers, subsidiaries, and agencies associated with this Promotion are not eligible to enter (“Ineligible Entrant”).
2.4 “Immediate family member” includes a spouse, ex-spouse, de facto partner, child or stepchild, parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-sibling, or first cousin.

3. Prize Draw

3.1 The draw will take place at the Promoter’s premises at Verve Intimate, 2 York Street, Richmond, VIC 3121 (or such other address as notified) at the time and date stated in the Schedule.
3.2 The Winners will be selected at random — chance alone determines the outcome.
3.3 If the draw falls on a weekend or public holiday, it will be conducted at the same time and place on the next business day.
3.4 The Promoter may draw reserve winners in case of an invalid entry or uncontactable entrant.
3.5 All reasonable attempts will be made to contact the Winners.

4. Prize Delivery & Redemption

4.1 Unless otherwise stated in the Schedule, the Prize will be emailed to the Winners using the address provided in their entry (or another address later advised by the winner).
4.2 The Prize is deemed collected when:
(a) the Promoter receives an automated message confirming delivery; or
(b) one (1) hour after the Promoter’s email timestamp — whichever occurs first.
4.3 The Promoter and the Winners may agree on an alternative collection method at the Promoter’s discretion.
4.4 If the Winner does not claim or take their Prize by the time specified, it will be forfeited and will not be replaced.
4.5 The value of the Prize is accurate as at the Start Date. The Promoter accepts no responsibility for changes in value thereafter.
4.6 Prizes are not exchangeable, redeemable for cash, or transferable, unless otherwise specified in writing by the Promoter.
4.7 Any costs associated with redeeming or collecting the Prize are the sole responsibility of the Entrant.

5. Social Media

5.1 This Promotion may be advertised via social media platforms.
5.2 Any questions or comments must be directed to the Promoter, not to Facebook, Instagram, or other platforms.
5.3 Entrants acknowledge that this Promotion is not sponsored, endorsed, administered, or associated with Facebook, Instagram, or their parent companies.
5.4 Entrants release Facebook and Instagram from all liabilities related to this Promotion.

6. Prize Substitution

If the Prize (or part of it) becomes unavailable, the Promoter reserves the right to substitute it with a prize of equal or greater value and/or specification.

7. Entry Conditions

7.1 There is no entry fee, other than the entrant’s cost to access the website via their internet service provider.
7.2 The Prize will be awarded to the individual named as the entrant. Entries on behalf of another person are invalid.
7.3 If there is a dispute as to an entrant’s identity, the Promoter reserves the right to determine, in its sole discretion, the rightful entrant.

8. Privacy

8.1 Entrants’ personal information is collected and stored by the Promoter for the purposes of conducting the Promotion and future marketing.
8.2 The Promoter is bound by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
8.3 The Promoter’s Privacy Policy, available at https://www.verveintimate.com.au/privacy-policy, explains how entrants may access, update, or correct their personal information, and how to lodge a privacy complaint.
8.4 Entrants’ details may be disclosed to contractors, agents, prize suppliers, or service providers assisting with this Promotion.
8.5 Failure to provide personal information may render an entrant ineligible to participate or claim a Prize.
8.6 For public announcements, the Promoter may publish only the winner’s surname, initial, and postcode.

9. Third-Party Prizes

If the Prize involves a third-party supplier, their terms and conditions apply. The Promoter accepts no responsibility for any delay, cancellation, or failure by the third party in providing the Prize.

10. Legal & Consumer Rights

10.1 Nothing in these Conditions restricts or modifies any rights under the Competition and Consumer Act 2010 (Cth)or other applicable laws.
10.2 If any part of this Promotion cannot run as planned due to causes beyond the Promoter’s control (including technical issues, pandemics, or fraud), the Promoter may cancel, suspend, or modify it as permitted by law.

11. Validation & Disqualification

11.1 The Promoter reserves the right to verify entries and entrants’ details (including identity, age, and residency).
11.2 Failure to provide suitable proof will result in forfeiture of the Prize.
11.3 Incomplete, indecipherable, or offensive entries will be invalid.
11.4 Automated or multiple entries using mechanical or electronic means are prohibited.
11.5 The Promoter’s decision in all matters is final.

12. Liability

12.1 The Promoter and associated agencies are not liable for any loss, damage, or injury suffered in connection with this Promotion or any Prize, except where liability cannot be excluded by law.
12.2 All expenses outside the Prize inclusions are the responsibility of the Winners.
12.3 Once a Prize is delivered or collected, the Promoter accepts no responsibility for its use, loss, or cancellation.

13. Marketing & Publicity

13.1 Entrants agree to participate in reasonable marketing activities related to the Promotion (such as being photographed, filmed, or interviewed).
13.2 The Promoter may use this material for promotional purposes without additional compensation.

14. General Conditions

14.1 Unless stated otherwise, each Prize is a single prize per Winner and cannot be split into components.
14.2 The Promoter accepts no responsibility for any tax implications — entrants should seek independent advice.
14.3 Failure by the Promoter to enforce any right does not constitute a waiver.

Prize Experience Terms

Validity

• Complimentary Boudoir Photography Gift Experiences and Prizes are valid for 2 months from the date received.

• The Prize Winner’s photoshoot must be booked within this period.

• Need extra time? Email [email protected] and we’ll do our best to accommodate.

Exclusivity

• Prizes are not redeemable for cash, non-transferable, and cannot be combined with any other promotion or special offer.

• They must be used strictly as outlined by Verve Intimate.

• Prizes cannot be applied to past sessions.

Limit

• Only one gifted experience or prize per person per calendar year may be redeemed.

Securing Your Session

• To confirm your booking, a fully refundable $195 holding deposit is required.

• This secures the Winner’s professional hair and makeup appointment, photoshoot, and design consultation.

• The Winner’s deposit will be fully refunded after their image reveal session.

Fairness & Discretion

• Verve Intimate reserves the right to withdraw or modify a prize at any time.

• If this occurs, any payments made (such as a holding deposit) will be fully refunded.

• All changes will be handled with transparency, fairness, and kindness.

Minimum Age

• All recipients must be 18 years or older on the date of their photoshoot.

Confirmation

• If a Prize Winner’s appointment is not confirmed, Verve Intimate reserves the right to cancel their Prize or consultation.

Love Your Images Guarantee

• We want you to absolutely adore your images — because your experience should leave you feeling empowered and proud.
  
  If, when viewing your final digital images in your image reveal session, you’re not happy with them, we’ll refund any payments made.
  
  (Please allow time for your bank to process the refund once we’ve issued it.)

Rescheduling Your Photoshoot or Design Consultation

We understand that life happens. Here’s how it works:

• You may reschedule once, free of charge, with at least 5 days’ notice.

• Less than 5 days’ notice, multiple reschedules, or missed appointments will forfeit the Prize and any fees paid.

• All rescheduled appointments must occur within 2 months of the original date and are subject to availability.

Cancelling Your Photoshoot

• Cancel with at least 7 days’ notice to receive a full refund.

• Unfortunately, cancellations made with less than 7 days’ notice are not refundable, and will result in the Prize being forfeited, as time and resources have already been allocated.
